1. Terms of a contract
1.1 Our offers are not binding. The execution of orders follows only in accordance with these general terms and conditions, even if no written purchases are given.
1.2 These terms and conditions apply to the entire business relationship with the customer, even though in subsequent transactions will no longer be made reference to them.
1.3 Deviant contract conditions of the customer and complementary or changing additional agreements are only valid if we have confirmed them in writing.
1.4 Should single contractual agreements be ineffective, the contract still remains valid. The ineffective arrangement is to be reinterpreted in such a way that the purpose deliberate by them is reached in the best way possible.
1.5 The customer can resign contract laws neither nor pledge.
1.6 German law applies.
1.7 With technical dates as well as write errors and arithmetic mistakes on the website www.vip-kaminfeuer.de the Woitha Ofenbau GmbH is entitled to the resignation, without claims arise to the customer out of this.
1.8 The following rights apply only to private consumers, i.e. any natural person who enters into a transaction for a purpose that is neither commercial nor their independent vocational activity may be attributed. For merchants, companies and public bodies subject to the regulations of the Commercial Code (HGB).
2. Offer
2.1 Our offers are non-binding in every case. All product specification educations and pictures in our shop follow without grant on correctness (particularly concerning paint, technical dates and technical pictures) and completeness. We reserve ourselves to carry out changes in the products, product descriptions and terms of business without previous announcement.
3. Delivery
3.1 All orders are accepted only under the reservation of the delivery possibility. Events force majeure like strike, closing down, operational disturbance, carriage or container shortage, road barriers and other unforeseen cases release us from the received liabilities of delivery. Stated delivery times are to be looked only roughly and begin only after final written clarification of the order.
3.2 Our deliveries are free, free curb.
3.3 Delivery is generally only within Germany. Shipping to European countries after agreement only.
3.4 Shipping damage and visible defects as a complaint please note on bill of lading and you get a confirm from the driver. These defects are immediately but not later than within 3 days after delivery of the goods at the destination to display phone, mail or email. Otherwise, complaints shall be excluded.
3.5 The delivery of the goods by the carrier shall be deemed proof of receipt, and the proper packaging and quantity.
4. Price and Payment
4.1 Our prices are based on the cost ratios when placing the order.
4.2 All prices are per piece. Prices are net with no VAT.
4.3 By handing over the goods, the invoice is due. Late payment will also delay and without prior notification to the legal consequences.
4.4 Shall be paid either by cash or card. Delivery costs will be billed separately.
4.5 For payment in advance no cash on delivery charges.
4.6 For partial deliveries, the price of goods is also due immediately.
4.7 With default www.vip-kaminfeuer.de is entitled to calculate interests for delay at the rate of at least 3% about the in each case valid base interest rate clause according to Diskontsatzüberleitungsgesetz(DÜG), nevertheless 6% p.a. plus reminder fees and perhaps incidental attorney's fees.
5. Guarantee
5.1 Our product is exclusively an orginale brand product which was produced for the European market. The product comes directly from the manufacturer and never from rest purchases.
5.2 All fireplaces introduced on our website like fireplace-stoves, fireplace-applications, fireplace-kits etc. are checked by the German Institute for Standardization and are admitted for the German / European market.
5.3 The guarantee lasted by the manufacturer is transmitted on the customer (between 3 and 5 years according to manufacturer).
5.4 The customer can assert claims because of an evident shortage only immediately on receipt of the product.
5.5 All shortages are immediately to be indicated us after statement before an installation or a wide disposal in writing. If the customer processes the product delivered by us in spite of recognizable shortages, any guarantee is cancelled.
5.6 By dispatch by means of truck a protocol in which the extent of the damage is exactly registered is to be recorded. This protocol is to be signed by the driver.
5.7 No guarantee is taken over, for the damages which have originated for following reasons: Wears, e.g. in oscillating grate, fire-clay, glass and tiles, inexpedient or improper use, faulty installation by the customer or third, natural wear, faulty or negligent treatment. Scratches and shyness construction which have originated from the transport cannot be complained. Stove - spray varnish becomes the removal of such places used.
6. Exchange and Return Policy
6.1 The consumer can revoke the order within 2 weeks from preservation of the product without grounds. The product is to be sent back to the supplier. If you have any questions our customer service will help you.
6.2 Carriage costs for the way there to the customer cannot be paid back when return.
6.3 The customer has to bear the costs of a depreciation if this is not to be led back exclusively on the audit of the ordered product and therefore a resale cannot be carried out.
6.4 Restitutions are ordinarily paid by referral. However, if requested the dispatch of a crossed cheque is also possible.
7. Privacy
7.1 The purchaser is hereby informed that the seller obtained the personal data solely in terms of business activity in the context of the laws of the Federal Data Protection Act (BDSG) and the Information and Communication Service Act (IuKDG) and the Teleservices Data Protection Act (TDDSG) processing and storage. Personal data collected by us is stored and handled with the utmost confidentiality. We do not give data of any kind to third parties. We may, however, occasionally send you information and promotions.
8. Copyright
8.1 We proceed against offence of the copyright within the scope of the legal possibilities by a lawyer.
